1925 Burwood Cinema Case

Burwood Cinema Limited and Others v The Australian Theatrical and Amusement Employees' Association (Burwood Cinema Case) (1925) 35 CLR 528 – Knox C.J., Isaacs, Gavan Duffy, Powers, Rich and Starke JJ., Judgment, 1 May 1925

The High Court holds that an industrial organisation has created an 'industrial dispute' within the meaning of s.51(xxxv) of the Constitution even though:

  • the log of claims relates not only to currently employed members but also to members who may be employed by the employer respondents in the future; and
  • not all employees of certain employer respondents were dissatisfied with their wages and conditions.
