A person is covered, and therefore eligible to make an application for orders to stop sexual harassment, if they:

are a worker (as defined in the Work Health and Safety Act 2011 (Cth) (WHS Act)))[21]
-
are not a member of the Defence Force[22] and
-
have experienced sexual harassment at work in a constitutionally-covered business.[23]

The laws also cover:
-
constitutionally-covered businesses for whom the worker performs work, and
-
persons who are named in applications under s.789FC of the Fair Work Act as having engaged in bullying or sexual harassment (or both).
