An employer shall not discriminate against members of the Amalgamated Society of Carpenters and Joiners of Australia (S.A. Branch), or of the Amalgamated Construction, Mining and Energy Union of Australia (S.A. Branch), in respect of the engagement or dismissal of employees and shall give preference of employment to members of either union in cases where a member of either union and a person who is not a member are offering for service or employment at the same time, and in the case of retrenchment to the point where either such a member or such a person is to be dismissed from service or employment. Provided that an employer is only obliged to give such preference where all factors relevant to the circumstances of the particular case are otherwise equal.
Should a dispute arise between the Brethren and the Amalgamated Society of Carpenters and Joiners of Australia, South Australian Branch or between the Brethren and The Amalgamated Construction, Mining and Energy Union of Australia, South Australian Branch in relation to this clause and it is not resolved, the dispute will be referred to the Commission for determination.
