PART 6 - HOURS OF WORK, BREAKS, OVERTIME, SHIFTWORK, WEEKEND WORK 

20. HOURS OF WORK

20.1 The ordinary hours of work for weekly employees will not exceed 38 per week, nor 10 hours per day within a span of 13 hours commencing not earlier than 9:00am and finishing not later than 12:00 midnight, except in the event of daylight saving being applicable when 12:00 midnight becomes 1:00am provided the starting time is put back by an equal amount of time, to operate in each state or territory (as the case may be) during each period of “Daylight Saving Time” as prescribed by the law of such state or territory.

20.2 Not withstanding the provisions herein, in special circumstances the employer and the employee may agree in writing to observe other daily hours for working 38 hours per week. The Theatre Managers’ Association will be provided with a copy of such agreement.

20.3 All ordinary hours worked outside the span of 13 hours on any day will be paid for at the rate of time and a half for the first hour and double time thereafter.

20.4 In cinemas classified under the first schedule of the schedule of theatres where both a manager and an assistant manger are employed, the ordinary hours of work will be worked consecutively except for meal breaks or in the case of an emergency.

20.5 Time off

20.5.1 Weekly employees will be free from duty for a minimum of two days each week and such days will be consecutive where reasonably possible. If any of the days mentioned herein are not given and taken, payment will be made at the rate of time and a half for the first two hours and double time thereafter for all hours so worked with a minimum payment as for four hours.

20.5.2 Employees will be granted a ten hour break between the cessation of work on one day and the commencement of work on the following day. Where such a break is not granted the employee will be paid at double time until the full ten hours has expired.

20.6 Each employee will be provided with a written statement setting out the normal weekly working hours, and in particular, the starting and finishing times and meal breaks to be observed by the employee concerned. The employer will not, except in case of emergency, alter the employee’s normal hours of work as specified in the aforesaid statement unless and until it is withdrawn by the employer and furnishes the employee with a statement setting out the altered hours of work for the employee concerned. No rosters will be withdrawn without giving to the employee concerned at least six days notice thereof, except in the case of emergency or with the employee’s consent.
