24. SUNDAY WORK

24.1 An employee other than a casual who is called upon to work on a Sunday will be paid in accordance with the following provisions. Time worked on a Sunday, if the employee so elects, will be part of the employee’s ordinary hours of work for the week.

24.2 Where the time worked on a Sunday is part of the employee’s ordinary hours of work for the week, the minimum payment under this subclause will be one quarter of the employee’s ordinary weekly pay, provided that in such case the employee’s hours of work for the week will be so arranged that one complete day off duty (including the evening of the day off) in that week will be given. All time worked in excess of ordinary hours will be paid at double time and a half.

24.3 Where the time on a Sunday is in addition to the employee’s ordinary hours for the week, the minimum payment under this subclause will be one half of the employee’s ordinary weekly pay, and at the rate of double time and a half for all work in excess of eight hours.

24.4 When the 25th day of December falls on a Sunday, a weekly employee who normally works on Sundays as part of the five day week and who does not work on Sunday 25 December because the theatre is closed will nevertheless be paid the penalty rate applicable to work on a Sunday. Provided however that in that case the employee will not be entitled to the day off prescribed in this clause.

24.5 The calculation of rates in this clause will, except where it is agreed that the actual rate paid includes an amount to compensate for overtime worked or to be worked, be on the actual rate paid to the employee. .The rates payable under this clause will not be cumulative with the rates payable under the overtime provisions of this award so as to entitle an employee to payment in excess of double time and a half.
