23. TIME OFF IN LIEU OF OVERTIME

23.1 Such arrangements will be done on an individual basis, as agreement must be reached between an individual employee and the employer.

23.2 An employee who works overtime, retains the choice of being paid for overtime worked or receiving time off in lieu of overtime.

23.3 Substitute time may be banked to a maximum of 38 hours at any one time.

23.4 Overtime hours worked on Monday to Saturday will qualify for an equal number of ordinary hours time off, eg four hours worked equals four hours off.

23.5 Overtime worked on Sunday or Public Holidays will accrue at the rate prescribed by the award for each hour worked.

23.6 Time off accrued when taken is to be paid at the current rate of pay.

23.7 If the employee works during any agreed time off period the following will apply:

23.7.1 The employer and the employee may agree upon an alternative period of time to be taken off in substitution, or

23.7.2 If there is no agreement to an alternative period of time to be taken off in substitution then employees will be paid at the appropriate overtime rate for that period of the accrued time worked.

23.8 Any untaken accrued time off may be added to annual leave and paid for at the appropriate rate, or may be paid out upon termination of employment.

23.9 After consultation with the employee the employer will decide the most appropriate period in which time off in lieu of overtime will be taken provided that the employee will take time off in lieu of overtime not later than six months after the overtime hours are banked.

23.10 The provisions contained in the above clauses will not apply to work carried out during late shows ceasing after midnight on any day.
