22. OVERTIME

22.1 All time worked outside the time of beginning and ending work as prescribed in hours of work clause of this Award, will be paid for at the rate of double time.

22.2 All time worked within the times of beginning and ending work in excess of the hours fixed for a week’s work will be paid for at the rate of time and a half for the first two hours and double time thereafter.

22.3 The calculation of rates in this clause will, except where it is agreed that the actual rate paid includes an amount to compensate for overtime worked or to be worked, will be on the actual rate paid to the employee. The rate payable under this clause will not be cumulative.

22.4 An employee recalled to work overtime after leaving the place of employment, except for the partaking of a meal, will be paid for a minimum of three hours’ work at the appropriate rate.

22.5 An employee who works at a performance which begins after the usual closing time of 12:00 midnight or thereabouts will be paid for such performance two-fifths of the appropriate weekly wage. Where a midnight performance carries on after 4:15am payment will be made for all time worked after 4:15am at double time.

22.6 If the midnight performance is held on a Saturday into a Sunday the Sunday rate of pay will apply from 12:00 midnight.

22.7 Notwithstanding the provisions herein, in the event of “Daylight Saving” being applicable, during each period of “Daylight Saving Time” as prescribed by law of such state or territory, when 12:00 midnight becomes 1:00am provided the starting time is put back by an equal amount of time.
