30. PUBLIC HOLIDAYS

30.1 If you are a full time or part time employee, then in addition to any other leave entitlements you have under this Award, you are also entitled without loss of pay to holidays on the following:

30.2 You will also be entitled to holidays on the following days if those days have been declared public holidays in your State or Territory:

30.3 You will also be entitled to one additional day’s holiday on the day appropriate to your State or Territory as follows:

30.4 If your State, Territory or locality declares another day as a public holiday in substitution for one of the days listed in this clause, you will be entitled to a holiday on the substituted day instead of the listed day.

30.5 If Christmas Day falls on a Saturday or Sunday, you will be entitled to a holiday in lieu on 27 December. If Boxing Day falls on a Saturday or Sunday, you will be entitled to a holiday in lieu on 28 December. If New Year’s Day or Australia Day falls on a Saturday or Sunday, you will be entitled to a holiday in lieu on the next Monday.

30.6 If in your State or Territory more days are declared public holidays than those listed in this clause, weekly employees will also be entitled to be paid leave for those days.

30.7 In the case of employees engaged by the week, if by reason of any of the public holidays referred to in this clause being a public holiday and no work is done thereon, the employee’s prescribed rate for the week will nevertheless be paid.

30.8 Where an employee’s rostered day off falls on a public holiday the employee will be allowed an additional day off, at a time to be agreed upon by the employer and employee, or be paid an additional day in lieu thereof within seven days of the aforementioned holiday.

30.9 Where an employee’s rostered day off falls on a public holiday and the employee is required to work on that day, the employee will be paid for such work done on that day the rates prescribed in this award and such employee will be allowed an additional day’s pay in lieu thereof within seven days of the aforementioned public holiday.

30.10 An employee called upon to work on Christmas Day, Good Friday or Labour Day will be paid at the rate of double time and a half for all time worked with a minimum payment as for a full day.

30.11 An employee called upon to work on all other public holidays prescribed above will be paid at the rate of double time and a half with a minimum payment for four (4) and a quarter hours.

30.12 A casual employee called upon to work on any public holidays prescribed above, will be paid at the rate of double time and one half with a minimum payment as for four and a quarter hours.
