SCHEDULE 3 (AWARD PARAGRAPHS 5.2.2 AND 5.2.3)
TERMS WHICH MUST BE INCLUDED IN A FIXED TERM CONTRACT OF EMPLOYMENT
1. APPOINTMENT AND TERM
1.1 The station (1) appoints the journalist (1) and the journalist(1) agrees to work for the station(1) as a journalist (1) on a full-time basis for (insert period of employment which must be at least one year) (hereinafter called the initial term).
1.2 At least four weeks before the expiration of the initial term the station (1) must advise the journalist(1):
(a) that his or her services will no longer be required; or
(b) that at the conclusion of the initial term, the station(1) wishes to employ the journalist(1) for a further specified term of not less than twelve months duration.
(c) that the station(1) wishes to employ the journalist(1) after the conclusion of the initial term under the provisions of the Journalists (Television) Award 1998(2) (the award); and
(d) the salary and other benefits and the conditions that will apply to any continued employment contract.
1.3 If the journalist(1) is offered further employment the journalist(1) must advise the station(1) as soon as possible before the initial term ends whether that offer is accepted.
1.4 If the station(1):
(a) advises the journalist under 1.2(a) that his or her services will no longer be required; or
(b) offers further employment which the journalist(1) does not accept
the employment will terminate at the end of the initial term.
2. SALARY AND OTHER BENEFITS
The station(1) must pay the journalist(1) a salary of the amount and at the times stated in Annexure A and must grant the journalist (1) the benefits stated in Annexure A.
3. APPLICATION OF AWARD
3.1 The parties acknowledge that this agreement is made in accordance with the right given under the award for the journalist(1) to be exempt from certain provisions of the award.
3.2 The following provisions of the award are the provisions not applicable to the employment of the journalist(1) by the station(1):

4. TERMINATION
4.1 The station(1) may terminate this agreement at any time and without notice for refusal of duty, wilful and serious neglect of duty, disobedience of instructions or orders or misconduct.
4.2 The station(1) may also terminate this agreement by giving notice in writing to the journalist(1) if the journalist(1) has breached his or her obligations under this agreement and continues to do so after being given written notice of such breach by the station.
4.3 The journalist(1) may terminate this agreement if the station(1) is in breach of any material condition of this agreement and fails to rectify the breach within 14 days of being given notice to do so.
4.4 The journalist acknowledges that he or she will not be entitled to compensation if the agreement is terminated by the station(1) under paragraphs 4.1 or 4.2 hereof, except for any salary or benefits due under clause 3.1 hereof but unpaid at the date of termination and any payments to which the journalist(1) may be entitled under statute.
NOTES
(1) Any appropriate word can be used e.g. “employer” for “station” and “employee” for “journalist”.
(2) The title of the award as in force from time to time is to be used.
