AN150039 – Clerks' (South Australia) Award
CLAUSE 1.3 LOCALITY AND SCOPE
OPDATE 12:09:2001 on and from
1.3.1 This Award applies throughout the State of South Australia to:
1.3.1.1 the industry of the occupations of persons employed as clerks and other clerical and office workers whose classifications are set out herein whether as employers or employees and whether members of an association or not;
1.3.1.2 the occupation of persons whose principal duties are any or all of the following:
(a) the sale of goods and / or services via the telephone
(b)the promotion of goods and / or services via the telephone
(c) the collection of information via the telephone for the purposes of surveys, opinion polls, etc.
(d) the promotion and sale of lottery tickets or similar via the telephone
(e) the seeking of or collection of donations to any organisation or association via the telephone
1.3.2 This Award is not binding on those persons who are for the time being subject to (e) another award or order of the Commission or that of the Australian Industrial Relations Commission or upon:
(1) any bank or insurance company;
(2) any bookmaker;
(3) articled clerks or chartered accountants (Aust.) employed by chartered accountants (Aust.)
(4) hospitals (other than government hospitals) in respect of persons who are not primarily employed as clerks or switchboard attendants and in respect of voluntary workers, persons in religious orders of nurses even when employed as clerks or switchboard attendants;
(5) OneSteel Manufacturing Pty Ltd in respect of any of its clerks employed at Whyalla, Iron Knob, Iron Baron, Rapid Bay, Ardrossan and Coffin Bay;
(6) religious organisations in respect of persons and voluntary workers engaged in the office or registry of such organisations whose duties are predominantly those related to the administration of that organisation's religious activities;
(7) persons who fall within the definition contained in subclause 1.3.1.2 of this Award employed by:
(a) Multiple Sclerosis Society of South Australia and Northern Territory
(b) Epilepsy Association of South Australia
(c) Mary V Lucas Telemarketing
(d) Muscular Dystrophy Association of South Australia for the period 1 February 1997 up to and including 31 January 1998;
(e) and Paraplegic and Quadriplegic Association of South Australia Inc for the period 1 February 1996 up to and including 31 July 1997.
