(1) Except in the case of a casual employee, the contract of hiring of every employee shall be a weekly contract terminable by one week's notice on either side, given on any working day or in the event of such notice not being given by the payment of one week's pay by the employer or the forfeiture of one week's pay by the employee.
Provided that for the first month of employment the contract of service shall be by the day, terminable by one day's notice on either side or by the payment or forfeiture of one day's pay.
Provided further that the employer may at any time, dismiss an employee for misconduct, in which case wages shall be paid up to the time of dismissal only.
(2) The employer shall be under no obligation to pay for any day not worked upon which the employee is required to present himself for duty, except when such absence from work is due to illness and comes within the provisions of clause 17. - Absence Through Sickness, or such absence is on account of holidays to which the employee is entitled under the provisions of this award.
(3) The employer shall be entitled to deduct payment for any day or portion of a day upon which the employee cannot be usefully employed because of any strike by the union or unions affiliated with it, or by any other association or union, or through the breakdown of the employer's machinery or any stoppage of work by any cause which the employer cannot reasonably prevent.
(4) (a) On the first day of engagement an employee shall be notified by his employer or by the employer's representative whether the duration of his employment is expected to exceed one month and, if he is hired as a casual worker, he shall be advised accordingly.
(b) An employee shall, for the purposes of this award, be deemed to be a casual employee -
(i) if the expected duration of the employment is less than one month; or
(ii) if the notification referred to in paragraph (a) of this subclause is not given and the employee is dismissed through no fault of his own within one month of commencing employment
