AN170010 – Building and Construction Industry Award
(a) Tradespersons and Builders Labourers
(i) One day’s notice of termination of employment shall be given on either side or one day’s pay shall be paid or forfeited.
(ii) Subject to the termination provisions of Clause 46 - Living Away From Home - Distant Work of this award, notice given at or before the usual starting time of any ordinary working day shall be deemed to expire at the completion of that day’s work.
(iii) A tradesperson shall be allowed one hour prior to termination to gather, clean, sharpen, pack and transport tools.
(iv) othing in this clause shall affect the right of an employer to dismiss an employee without notice for misconduct or refusing duty.
(v) Provided that an employee engaged by the same employer on a regular and/or systematic basis for a sequence of periods of employment of less than five days shall not be a casual hand and shall be entitled to all the conditions of a non-casual tradesperson or labourer.
(b) Plant Operators and Civil Construction and Maintenance Workers
(i) The termination of all weekly engagements shall require one week's notice on either side given at any time during the week, or the payment or forfeiture of one week's wages, as the case may be.
(ii) PROVIDED that where an employer has given notice to a weekly engaged employee, the employer shall, if requested, grant leave of absence without pay for one day to enable the employee to look for alternative employment.
(iii) Termination of all casual engagements shall require one day's notice on either side given at any time during the week or the payment or forfeiture of one day's wages, as the case may be.
(iv) This subclause shall not affect the employer's right to dismiss an employee without notice because of the employee's incompetence or misconduct, in which case the employee shall be paid all wages due up to the time of dismissal only.
