9. SPECIAL CONDITIONS

9.1 Notwithstanding anything else in this award, the Company and an employee may agree to vary an employee's hours and conditions of employment under this award in the following circumstances:

• to meet special circumstances; or;
• if the Company requires an employee to travel away from his or her usual place of employment.

9.2 The special conditions must be in writing and signed by the employee in Australia.

9.3 A copy of any agreement must be provided to the federal office of the relevant union within seven days of the implementation of, or alteration to, the special conditions or letters of posting.

9.4 If the Company and the employee fail to reach agreement as to the special conditions; or any of the parties to this award object to the special conditions; the matter may be referred to the Commission for arbitration.

9.5 The matter must be referred to the Commission within three months of the notification by the Company in accordance with 9.3.

9.6 Pending the outcome of the arbitration, the special conditions as determined by the Company must apply and be observed by the employee.

9.7 Any decision of the Commission under this clause must operate from the date of commencement of the duties subject to the special conditions. The Company must keep any records that are necessary to give effect to this retrospectively.
