19. NOTICE OF EARLY RETIREMENT AND EARLY RETIREMENT ALLOWANCES
19.1 For the purposes of this Clause, the following terms are defined:
19.1.1 Age in years of the employee on retirement will be calculated in accordance with the provisions of section 6 of the Superannuation Act 1976.
19.1.2 Eligible employee means an employee who is employed in a classification in Table 19A who has attained the age of 50 years and whose relevant period of flight service or air traffic control service exceeds 10 years.
19.1.3 Final annual rate of salary has the same meaning as in the Superannuation Act 1976.
19.1.4 Relevant licensing authority means the person who, in accordance with the Civil Aviation Regulations as in force from time to time, is empowered to licence a person to be an Air Traffic Controller or a Flight Service Officer.
19.1.5 Relevant period of flight service or air traffic control service means the period, or the sum of the periods, during which the employee was employed:
19.1.5(a) in one or more of the classifications specified in Table 19A, or
19.1.5(b) as a communication officer immediately before being employed in a classification specified in Table 19A, and the employee was directly translated, converted or promoted to a classification specified in Table 19A,
but does not include
19.1.5(c) any period of service occuring before the employee was granted an Air Traffic Controller or Flight Service Officer licence by the relevant licensing authority or graduated from an Air Traffic Controller or Flight Service Officer course conducted by, or on behalf of, the relevant licensing authority,
19.1.5(d) any period of service before the employee last became an employee,or
19.1.5(e) periods of leave without pay which have been determined not to count as service.
19.2 An employee is entitled to retire from Airservices on becoming an eligible employee for the purpose of this Clause.
19.3 Subject to 19.4, an eligible employee who retires from Airservices before, or upon attaining the age of 60 years, will be entitled to be paid an amount equal to the product of A, B and C where:
A is the final annual rate of salary of the eligible employee,
B is the factor specified in Table 19B opposite the age in years of the employee on retirement, and
C is the number of years of service the eligible employee has completed in the relevant period of flight service or air traffic control service.
19.4 An eligible employee will not be entitled to payment in accordance with clause 19.3 if the Chief Executive Officer is satisfied, having regard only to the operational requirements of Airservices Australia relating to air traffic control or flight service, that the retirement of the employee is not in the interests of Airservices.
