30. RESTRICTION DUTY

30.1 The employer may require an employee to be ready to perform extra duty, outside his or her ordinary hours as set out in this clause.

30.2 An employee is entitled to payment for restriction duty where he or she is advised prior to finishing normal duty that he or she:

30.2.1 will be on restriction roster for a specified period occurring before his/her next normal start time,

30.2.2 must be contactable and able to respond within 5 minutes of being contacted,

30.2.3 must be prepared to commence duty at the workplace without delay.

30.3 Prior to the commencement of the roster, the employer must advise an employee on restriction duty which of the following two hourly rates will apply:

30.3.1 an employee on restriction duty will normally receive an amount of $1.93 for each hour, or part thereof, of the period of restriction;

30.3.2 an employee will receive an amount of $2.95 per hour, or part thereof, for the period of restriction when the employer expects he or she will be able to accomplish some tasks from home. This rate of payment compensates for overtime undertaken while away from the workplace which is directly attributable to the employee’s restriction.

30.4 Where an employee on restriction is recalled for duty at the workplace, the employee will receive overtime payments in accordance with 27 - Overtime.

30.5 The circumstances in which an employee on restriction would be required to report for duty at the workplace, while on restriction, will be defined by the employer and advised to the employee prior to that employee commencing a period of restriction.
