29. REST AFTER OVERTIME AND EMERGENCY DUTY

29.1 An employee is entitled to absence from duty where he or she has worked overtime and there is less than an eight hour break until the employee’s next regular starting time.

29.2 The employee is entitled to absent him/herself from duty for eight hours (plus reasonable travelling time) without loss of pay.

29.3 If an employee is directed to work without eight consecutive hours off duty (plus reasonable travelling time), the employee must be paid twice the rate of pay he or she is entitled to, until he/she has had this break.

29.4 These provisions apply where an employee works overtime as set out in 28 - Emergency Duty, for 3 hours or more.

29.5 If the employee’s supervisor determines it is essential to grant respite from work to the employee who has undertaken emergency duty, the employee will be relieved from duty on his/her next regular shift, without loss of pay. The employee must not be absent for a period exceeding the number of hours extra duty worked. The period of relief from duty must not extend into the next rostered shift.

29.6 The provisions do not apply where an employee works less than 3 hours overtime immediately prior to starting an ordinary shift.
