28. METHOD OF WORKING THE 38 HOUR WEEK

28.1 The 38 hour week shall be implemented on one of the following bases, most suitable to the particular business, after consultation with, and giving reasonable consideration to the wishes of the employees concerned:-

28.1.1 by employees working less than eight ordinary hours each day; or

28.1.2 by employees working less than eight ordinary hours one or more days during each work cycle; or

28.1.3 by fixing one or more work days on which all employees will be of during a particular work cycle; or

28.1.4 by rostering employees off on various days of the week during a particular work cycle, so that each employee has one work day off during that cycle.

28.2 Notwithstanding any other provision in this clause, where the arrangement of ordinary hours of work provides for a rostered day off, the employer and the majority of employees concerned, may agree to accrue up to a maximum of five rostered days off. Where such agreement has been reached, the accrued rostered days off shall be taken within twelve calendar months of the date on which the first rostered day of was accrued. Consent to accrue rostered days off shall not be unreasonably withheld by either party.

28.3 Where a rostered day off falls on a public holiday, another day shall be agreed to be taken in lieu thereof.
