29.1 Meal breaks
29.1.1 Employees shall be entitled to a meal break of a minimum of 30 minutes and a maximum of one hour to be taken between the fourth and sixth hours from commencement of duty.
29.1.2 Where an employee is required to work during a meal break and continuously thereafter they shall be paid at the rate of time and a half until released from duty for a meal break.
29.1.3 Notwithstanding the provision of 29.1.2 herein, where an employee is required by the employer to have a meal with a client or clients as part of the normal work routine or client program they shall be paid for the duration of the meal period at the ordinary rate of pay.
29.1.4 However, an employee may elect to take an unpaid meal break as prescribed in 29.1.1 herein after the meal period. If the employee so elects not to have a meal break, all ordinary hours after the meal period shall be paid at the ordinary rate of pay.
29.1.5 By agreement, a part-time employee may forego their unpaid meal break provided that they must take an unpaid meal break on any day in which they work more than 6 hours continuously.
29.2 Rest pauses
29.2.1 Weekly employees shall receive a rest pause of ten minutes’ duration in the first half and the second half of each work day worked.
29.2.2 Provided that where the employer and employee so agree the two ten minute rest pauses may be combined into one twenty minute rest pause thus allowing for three continuous periods of work per day.
29.2.3 A casual employee who works a minimum of four consecutive ordinary hours but less than eight consecutive ordinary hours on any one day shall receive a rest pause of ten minutes’ duration in the first or second half of the day.
29.2.4 Rest pauses shall be taken in the employers’ time.
29.2.5 Rest pauses shall be taken at times to suit the convenience of the employer and so as not to interfere with the continuity of work where continuity is necessary.
