30. TRAVELLING, TRANSPORT AND FARES

30.1 Australian Capital Territory

30.1.1 Excess fares

In addition to other rates prescribed by this award, an employee shall be paid an allowance of (*) per day on each day the employee attends work to compensate for excess fares and travelling time.

30.1.2 Free transport

Provided, however, that the foregoing allowance shall not be payable if the employer provides or offers to provide suitable transport free of charge to the employee, in the employee's own time, in which case an allowance of (*) per day only shall be paid.

30.1.3 Motor vehicle allowance

An employee who, by agreement with the employer uses the employee’s own motor vehicle on the employer's business shall be paid an allowance of (*) per kilometre travelled.

30.1.4 Overnight absence

Where an employee is required in the course of the employment to be absent from the Australian Capital Territory overnight, the employer shall arrange and pay for accommodation and all out-of-pocket expenses necessarily incurred by such employee.

30.1.5 Payment when working away from Depot

The allowances under 30.1.1 and 30.1.2 hereof shall not apply to an employee permanently attached to a depot centre, but where an employee is directed to work away from a depot or centre on any day that employee shall be entitled to payment in accordance with 30.1.1 and 30.1.2 hereof.

30.1.6 Reimbursement for travel costs

30.1.6(a) Employees transferred from one job site to another during ordinary working hours shall be paid for the time occupied in travelling, and unless transported by the employer, shall be reimbursed reasonable cost of fares by the most convenient public transport between such job sites.

30.1.6(b) Provided that where the employer requests an employee to use their own vehicle to effect such a transfer, and the employee agrees to do so, the employee shall be paid the allowance in 30.1.8 hereof.

30.1.7 Where an employee travels each day outside a 50km radius to a construction site from the Canberra GPO, the employee shall be paid at the ordinary "hourly" rate calculated to the next quarter of an hour, with a minimum payment as for one half-hour for each return journey for any time outside ordinary working hours reasonably spent in travelling each day from the designated kilometre radius plus any expenses necessarily reasonably incurred in so travelling outside such radius.

30.1.8 Provided that where the employee uses their own vehicle such expenses shall be reimbursed at the rate of (*) per kilometre travelled outside such radius.

30.2 South Australia

30.2.1 Employees shall be entitled to the following fares and allowances when, at the employers' direction, they commence and/or finish work at the normal starting or finishing time at a place other than the employers' office, workshop or depot.

30.2.1(a) On jobs situated within 30 km radius of the employers' office, workshop or depot - an amount per day of (*).

30.2.1(b) On jobs situated within a 30-50 km - an amount of (*) per day.

30.2.1(c) On jobs situated beyond a 50 km radius of the employer's office, workshop or depot the amount per day for the first 50 km as prescribed in subclause (b) hereof. Beyond 50 km the employee shall also be entitled to reasonable travelling time per day with a minimum of quarter of an hour and excess fares where actually incurred.

30.2.1(d) Where the employer provides or offers to provide employees with transport up to 50 km - an amount of (*) per day.

30.2.1(e) Where the employer provides or offers to provide employees with transport on jobs situated beyond 50 km radius of the employer's office, workshop or depot an allowance of (*) per day, together with reasonable travelling time per day with a minimum of a quarter of an hour. Provided that, in accordance with the preceding subclause, travelling time shall be paid at ordinary rates, except on Sundays and public holidays, when it shall be at time and a half.

30.2.2 Motor vehicle allowance

Employees who, in the service of their employers, use their own motor vehicles at the request of their employer, shall be paid a mileage rate of (*) per kilometre.

30.3 Tasmania

30.3.1 Travel time allowance

All employees shall be paid an allowance of (*) for each day on which they present themselves for work. The allowance shall also be paid for rostered days off as provided in clause 20 of this award.

30.3.2 Travel time allowance - apprentices

Apprentices shall be paid the following percentages of the rate prescribed in 30.3.1 hereof as follows:

1st Year Apprentice

42 per cent

2nd Year Apprentice

55 per cent

3rd Year Apprentice

75 per cent

4th Year Apprentice

88 per cent

30.3.3 Travel allowance for start/finish on site

When required by the employer to start and/or cease work on the job site, employees shall be entitled to the following allowances as appropriate.

30.3.3(a) Where the job site is situated up to 50 km from the employer's registered office or depot(s) - an amount per day; or

30.3.3(b) Where the job site is situated more than 50 kms from the employer's registered office or depot(s) - the amount per day for the first 50 km as prescribed by 30.3.3(a) hereof, plus a payment for travelling time for each occasion the distance in excess of 50 km is travelled either to start work on the job site or after ceasing work on the job site, with a minimum payment of a quarter of an hour, plus payment for incidental expenses actually incurred.

30.3.3(c) Where the employer offers to provide transport free of charge, whether from the employee's home or the employer's registered office or depot(s) - an amount of (*) per day.

30.3.3(d) For the purpose of this clause an employer shall not have more than one registered office or depot within a 50 km radius.

30.3.3(e) When the employee is required to start and finish work at the employer's registered office or depot the allowances prescribed in this subclause are not payable.

30.3.4 Motor vehicle allowance

Employees who in the service of their employer use their own vehicles at the request of their employer shall be paid an amount of (*) per kilometre.

30.3.5 Travelling expenses

30.3.5(a) Fares

The employer shall arrange and pay for economy air fare or economy rail fare except when overnight rail travel is involved when a first class sleeping berth shall be provided.

30.3.5(b) Accommodation and lodging

30.3.5(b)(i) The employer shall arrange and pay for accommodation and lodging in a well kept establishment able to provide breakfast and an evening meal, adequate furnishings together with appropriate bedding, floor coverings, lighting, heating in either a single room or a twin room and with hot and cold running water.

30.3.5(b)(ii) Provided that an employee engaged on a construction project for which another award of this Commission or of the State Industrial Authority applies in respect of the majority of the workforce employed thereon shall be provided with accommodation in accordance with the provisions of such award in place of the preceding paragraph.

30.3.5(c) Meals

For all meals not included in the cost of fares or accommodation arranged by the employer an allowance of (*) per meal shall be paid to the employee.

30.4 Victoria

30.4.1 Travel time allowance

All employees shall be paid an allowance for each day on which they present themselves for work. The allowance shall also be paid for rostered days off.

30.4.2 Travel time allowance - apprentices

Apprentices shall be paid the following percentages of the rate prescribed in subclause 30.4.1 as follows:-

1st Year Apprentice

42 per cent

2nd Year Apprentice

55 per cent

3rd Year Apprentice

75 per cent

4th Year Apprentice

88 per cent

The allowance shall also be paid for rostered days off and for attendance at Trade School by apprentices.

30.4.3 Travelling expenses

Without limiting the generality of the clause, travelling expenses shall be:

30.4.3(a) Fares

The employer shall arrange and pay for economy air fare or economy rail fare except when overnight rail travel is involved when a first class sleeping berth shall be provided.

30.4.3(b) Accommodation and lodging

30.4.3(b)(i) The employer shall arrange and pay for accommodation and lodging in a well kept establishment able to provide breakfast and an evening meal, adequate furnishings together with appropriate bedding, floor coverings, lighting, heating in either a single room or a twin room (if a single room is not available) and with hot and cold running water.

30.4.3(b)(ii) Provided that an employee engaged on a construction project for which another award of this Commission or of the State Industrial Authority applies in respect of the majority of the workforce employed thereon shall be provided with accommodation in accordance with the provisions of such award in place of the preceding paragraph.

30.4.3(b)(iii) For all meals not included in the cost of fares or accommodation arranged by the employer an allowance of (*) per meal shall be paid to the employee.

30.4.4 Start and/or finish on job

When required by the employer to start and/or cease work on the job site, employees shall be entitled to the following allowances as appropriate.

30.4.4(a) Where the job site is situated up to 50 km from the employer's registered office or depot(s) an amount of (*) per day; or

30.4.4(b) Where the job site is situated more than 50 kms from the employer's registered office or depot(s) the amount per day for the first 50 km prescribed by subclause (a) hereof, plus a payment for travelling time for each occasion the distance in excess of 50 km is traveled either to start work on the job site or after ceasing work on the job site, with a minimum payment of a quarter of an hour, plus payment for incidental expenses actually incurred.

30.4.4(c) Where the employer offers to provide transport free of charge, whether from the employee's home or the employer's registered office or depot(s) an amount of (*) per day.

30.4.4(d) For the purpose of this clause an employer shall not have more than one registered office or depot within a 50 km radius.

30.4.5 Start/finish at employer's registered office

When the employee is required to start and finish work at the employer's registered office or depot the above allowances do not apply.

30.4.6 Motor allowance

30.4.7 Entitlement

The allowances prescribed in this clause shall not be taken into account when calculating overtime penalty rates, annual leave, sick leave, long service leave or public holiday payments.
