Severance pay prescription.
ORDER
A Following a decision on transcript on 25 May 2005, I make the following order:
1. That the severance pay prescription applicable to an employee of Boeing Constructors, Inc. who is covered by the Boeing Constructors Certified Agreement 2002 (Boeing Certified Agreement) and the Space Tracking Industry Award 1998, (the Employee), be varied to nil where the Employee is offered employment with the Raytheon Company (ACN 063 709 295) (Raytheon) (the Employment), provided that:
(i) the Employment will be in the same classification and at the same wage rate as, or on terms no less favourable than, the Employee’s employment with Boeing Constructors, Inc.;
(ii) the terms and conditions of the Employment will be in accordance with the Boeing Certified Agreement;
(iii) the Employee’s service with Boeing Constructors, Inc. will be regarded as service with Raytheon; and
(iv) Raytheon will recognise the accrued statutory entitlements for the Employee who accepts the Employment.
B. This order shall come into force from 3 June 2005 and shall remain in force for a period of one year.
