5.12 COMPASSIONATE LEAVE

5.12.1 Leave on full pay of up to three working days shall be granted to an employee on account of:

(a) Death or serious illness of a spouse, child, parent, legal guardian, grandparent, brother or sister of the employee;

(b) Death or serious illness of a child, parent, legal guardian, grandparent, brother or sister of the spouse of the employee; and

(c) Death or serious illness of a relative who has taken the place of a parent, or of a relative residing with the employee at the time of such illness or death.

5.12.2 For the purpose of sub-clause 5.16.1, leave shall only be granted in the case of a serious illness where the employee furnishes a medical certificate stating the nature and seriousness of the illness.

5.12.3 For the purposes of sub-clause 5.16.1 (a) and (b) a person with whom the employee has an established defacto relationship as per clause 5.20.5 shall be regarded as the spouse of the employee.

5.12.4 Where the period of leave granted as per sub-clause 5.16.1 is inadequate due to special circumstances, such as a delayed funeral or the necessity of the employee undertaking extensive travel, the Chief Executive Officer may grant further paid leave.
