AP799690 - Transport Workers’ (Oil Companies) Award 1998
5.1 Section II of this award will be binding upon the employers named in Schedule B and their employees, whether members of the union or not, engaged in any of the classes of work mentioned in certified agreements to be read in conjunction with this award in relation to the operations of the employers in all States of the Commonwealth, the Australian Capital Territory and the Northern Territory and upon the Transport Workers’ Union of Australia, its officers and its members.
5.2 This award will comprise the complete set of award provisions applying to employees described in 5.1 hereof. Notwithstanding the term of any other award, no other award will apply to employees covered by this award.
5.3 The provisions in Section II of this award will apply, except where varied by certified agreements approved by the Australian Industrial Relations Commission, in which case the provisions of the agreements will take precedence.
5.4 Nothing in this award shall operate to reduce an employee’s wage rate in existence at the commencement of this award.
