9. TIME OF TAKING LONG SERVICE LEAVE

9.1 Subject to 9.2 hereof, an academic employee who has qualified for long service leave shall be entitled to take long service leave at a time of his or her choosing, provided that at least six months written notice of such leave is given and, in the absence of such notice, the authorised officer consents.

9.2 Where an academic employee has accumulated a long service leave entitlement in excess of 4.5 months, the authorised officer may give the employee written notice to take up to three months of such leave, at a time convenient to the needs of the institution, provided that:

9.2.1 the authorised officer shall give the employee written notice of at least twelve months of the date on which leave must commence;

9.2.2 the employee shall not be required to take long service leave within 24 months of the intended date of retirement of the employee;

9.2.3 the minimum period of leave the employer can require an employee to take shall be six weeks;

9.2.4 in any case where an employee has taken leave pursuant to this subclause the authorised officer shall not require the employee to take a further period of long service leave for a period of two years after the end of that period of leave.

9.3 The coming into operation of these provisions shall not in any way affect or alter existing procedures, practices, legislation or orders in Council of a Governor of a State with regard to long service leave except to the extent that these provisions explicitly provide.
