15. EMPLOYMENT CATEGORIES

15.1 Full-time employment

Except as contained hereinafter, employment shall be on a full-time basis.

15.2 Part-time employment -

15.2.1 Employees may be employed on a regular part-time basis.

15.2.2 A part-time employee is one who:

15.2.2(a) works less than 38 hours per week within their rostered work cycle;

15.2.2(b) has reasonably predictable hours of work; and

15.2.2(c) receives on a pro rata basis equivalent pay and conditions to full-time employees who do the same work.

15.2.3 Before commencing part-time employment the employer and employee must agree on the number of hours to be worked by the employee, the days on which they will be worked and the commencing and finishing times for the work. The terms of this agreement may be varied by consent and such variation shall be in writing.

15.2.4 An employer is required to roster a regular part-time employee for a minimum of three consecutive hours on any shift. The hours of work shall be between 7.00 a.m. and 6.30 p.m. Monday to Friday inclusive.

15.2.5 An employee who does not meet the definition of a regular part-time employee and who is not a full-time employee will be paid as a casual employee.

15.2.6 Part-time employees shall be paid an hourly rate equal to the appropriate weekly rate, prescribed by this award for the employee’s classification, divided by 38.

15.2.7 All time worked in excess of the regular pattern of hours will be overtime and will be paid for at the appropriate overtime rate.

15.3 Casual employment

15.3.1 Employees may be employed on a casual basis. A casual wholesale merchandiser means a merchandiser engaged and paid as such. A casual traveller means a traveller engaged and paid as such.

15.3.2 Casual employees shall be engaged for a minimum of three hours. The hours shall be between 7.00 a.m. and 6.30 p.m. Monday to Friday inclusive.

15.3.3 Casual employees shall be paid at an hourly rate equal to the appropriate weekly rate divided by 38 plus casual loading of 20% in addition to the ordinary time rate of pay.

15.4 Probationary employment

An employer may employ a probationary traveller subject to the following conditions:

15.4.1 for a period of not more than three months;

15.4.2 the probationary traveller shall be employed at a minimum weekly rate of remuneration of 90% of the minimum weekly rate of remuneration prescribed in 18.1 of this clause, such rate to be calculated to the nearest multiple of 10 cents, less than five cents to go to the lower multiple, five cents or more to go to the higher multiple.

15.5 Substitute employees

In the case of absence from duty of a regular commercial traveller for a period exceeding three weeks his or her employer may employ a substitute employee. If such a substitute employee is retained in the employment for a period exceeding three weeks he or she shall be subject to the provisions of this award.
