5. DEFINITIONS

In this award:

5.1 approved means, unless otherwise stated elsewhere in this award, approved by the employer;

5.2 certificate in lieu means a certificate issued by a:

5.2.1 person registered to practice as a dentist, physiotherapist, chiropractor, osteopath, optometrist; or

5.2.2 psychologist who is a member (or eligible for membership) of the board of the Clinical Branch of the Australian Psychological Society;

5.3 dependant means a person maintained by and permanently domiciled with a teacher, including a spouse, a child under sixteen years of age, a full-time student child and a parent;

5.4 employer means the Secretary or any person nominated to act on his or her behalf;

5.5 government school means any school conducted by or on behalf of the State of Victoria;

5.6 Melbourne metropolitan area means an area defined by the employer within the boundaries formed by straight lines joining Werribee, Sunbury, Hurstbridge, Lilydale, Belgrave and Mt. Eliza;

5.7 primary teacher means a person who performs teaching duties primarily in preparatory year to Year 6.

5.8 promotion means movement from one position to another position at a higher classification level;

5.9 schedule means the schedule to this award;

5.10 secondary teacher means a person who performs teaching duties primarily in Year 7 to Year 12;

5.11 Secretary means Secretary to the Department of Education and Training or its successor;

5.12 special payments means any payment in the nature of allowances, howsoever named, made to teachers in consideration of nominated duties;

5.13 Spouse in relation to a teacher means a husband or a wife or a person who lives with the teacher as husband, wife or same sex partner on a bona fide domestic basis although not legally married;

5.14 subdivision means a point on the classroom teacher salary scale set out in the schedule;

5.15 teacher means a person employed to perform teaching duties in a government school;

5.16 transfer means movement from one position to another position within the same classification level or movement from one position to another position at a lower classification level;

5.17 union means the Australian Education Union.
