AP806227 - Teachers’ (Victorian Government Schools) Conditions of Employment Award 2001
10.1 A teacher shall be entitled to holidays on the following days:
10.1.1 New Year’s Day, Good Friday, Easter Saturday, Easter Monday, Christmas Day and Boxing Day; and
10.1.2 the following days, as prescribed in the State of Victoria: Australia Day, Anzac Day, Queen’s Birthday and Eight Hours’ Day or Labour Day; and
10.1.3 one other day which shall be either:
10.1.3(a) the first Tuesday in November (Melbourne Cup Day) where the teacher is employed at a school in a metropolitan municipal district; or
10.1.3(b) one other day as determined by a non-metropolitan municipal council and published in the Victorian Government Gazette where the teacher is employed at a school which is not in a metropolitan municipal district; or
10.1.3(c) one other day which is agreed to by the employer and the majority of affected teachers at the workplace.
10.2 When Christmas Day is a Saturday or a Sunday, a holiday in lieu thereof shall be observed on 27 December.
10.2.1 When Boxing Day is a Saturday or a Sunday, a holiday in lieu thereof shall be observed on 28 December.
10.2.2 When New Year’s Day or Australia Day is a Saturday or Sunday, a holiday in lieu thereof shall be observed on the next Monday.
10.3 Where in the State of Victoria public holidays are declared or prescribed on days other than those set out in 10.1.1 and 10.1.2 above, those days shall constitute additional days for the purpose of this award.

10.4 The employer may substitute another day for any prescribed in this clause subject to:
10.4.1 Every affected teacher and the union shall be informed of any substitution pursuant to 10.4.
