4. AREA, INCIDENCE AND DURATION

4.1 This award shall be binding upon:

• The Shop, Distributive and Allied Employees' Association (the union);

• The employers listed in Schedule 1; and

• Employees of those employers whether members of the union or not.

4.2 The award shall apply throughout Australia except in the case of employees who are members of the Australian Workers' Union and employed within the boundaries within Queensland, commencing at the sea-coast 24 degrees 30 minutes of south latitude, thence by that parallel of latitude bearing true west to 151 decrees of each longitude, thence by that degree of longitude bearing true sough to 25 degrees of south latitude; thence by that parallel of latitude bearing true west to the western border of the State; thence by the western border of the State bearing true north to 22 degrees 30 minutes of south latitude; thence by that parallel of latitude bearing true east to 147 degrees of east longitude; thence by that degree of longitude bearing true north to 22 degrees of south latitude; thence by that parallel of latitude bearing true east to the sea-coast; thence by the sea coast southerly to the point of commencement and including the islands adjacent to the Coast within that area excluding the Local Government Areas of Rockhampton and Gladstone.

4.3 This award shall apply to all work in or in connection with the receipt of orders for and/or preparation and/or sale and/or delivery of:

• meals, snacks and/or beverages, including but not limited to, pizzas, hamburgers, chicken, fish and chips, souvlakis, kebabs, muffins, noodles, rice, sandwiches, rolls, ice cream, coffee, juices, which are sold to the public primarily for take away; and/or
• take away foods and beverages packaged sold or served in such a manner as to allow their being taken from the point of distribution to be consumed elsewhere should the customer so decide; and/or
• food and/or beverages in food courts and/or in shopping centres and/or in retail complexes, excluding coffee shops, cafes, bars and restaurants providing primarily a sit down service in other than food courts of shopping centres and retail complexes.

4.4 It shall take effect from the beginning of the first pay period to commence on or after 15 December 2000 and shall remain in force for a period of twelve months.
