17. ALLOWANCES - ALL STATES AND TERRITORIES EXCEPT NSW

17.1 Meal allowances

17.1.1 Overtime

An employee required to work not less than one hour of overtime after his or her ordinary time of ending work shall be paid a meal allowance of $10.03, where 24 hours notice has not been given. Provided that where such overtime work exceeds four hours a further meal allowance of $9.04 shall be paid.

17.1.2 Late night

Any weekly employee entitled pursuant to 17.1.1 to a second meal break on a week day shall be paid a meal allowance of $10.00.

17.1.3 Sunday

An employee required to work more than four hours overtime on a Sunday shall be paid a meal allowance of $10.03 and a further $9.04 when required to work more than eight hours on such day.

17.1.4 Meal provided

The above allowances shall not be payable where the employer has his/her own cooking and dining facilities and by agreement with the employee supplies a substantial meal which shall consist of food comprising soup, entree or joint, vegetables and sweet.

17.1.5 Return home

These foregoing provisions shall not apply where an employee could reasonably return home for a meal within the period allowed.

17.1.6 Payment

Meal money shall be paid on the same day as the overtime is worked or shall be paid in the weekly or fortnightly pay.

17.1.7 Special clothing reimbursement

17.1.7(a) Where the employer requires an employee to wear any special clothing such as a uniform dress or other clothing then the employer shall reimburse the employee for the cost of purchasing such special clothing and the cost of replacement items, when replacement is due to normal wear and tear. This provision shall not apply where the special clothing is supplied and/or paid for by the employer.

17.1.7(b) Where an employee is required to launder any special uniform, dress or other clothing, the employee shall be paid an allowance of $4.53 per garment per week.

17.2 Protective clothing reimbursement

Where it is agreed the work performed by an employee is of a dirty, wet or obnoxious nature requiring suitable protective clothing, the employer must reimburse the employee for the costs incurred in purchasing the suitable protective clothing and any necessary laundering cost incurred by the employee. This shall not apply where suitable protective clothing is provided and laundered at the employer's cost.

17.3 Protective clothing reimbursement - freezer room

17.3.1 Where an employee is required to work in a freezer room, where the temperature is reduced by artificial means below 0° Celsius, the employer must reimburse the employee for the cost of purchasing suitable protective clothing.

17.3.2 The provisions of this clause do not apply where the suitable clothing is supplied to the employee at the employer's expense.

17.4 Excess fares reimbursement

Where an employee is required by his or her employer to move temporarily from one branch or shop to another for a period not exceeding three weeks all additional fares so incurred shall be reimbursed by the employer.

17.5 Travelling time reimbursement

17.5.1 An employee who on any day is required to work at a place away from his/her usual place of employment, for all time reasonably spent in reaching and returning from such place (in excess of the time normally spent in travelling from his/her home to his/her usual place of employment and returning), shall be paid travelling time and also any fares reasonably incurred in excess of those normally incurred in travelling between his/her home and his/her usual place of employment.

17.5.2 Where the employer provides transport from a pick up point, an employee shall be paid travelling time for all time spent travelling from such pick up point and return thereto.

17.5.3 The rate of pay for travelling time shall be the ordinary time rate except on Sundays and holidays when it shall be time and half.

17.6 Transfer of employee reimbursement

Where any employer transfers an employee from one township to another, the employer shall be responsible for and shall pay the whole of the moving expenses, including fares and transport charges, for the employee and his/her family.

17.7 Transport allowance

Where an employer occasionally requires an employee to use his/her own motor vehicle in the performance of his/her duties such employee shall be paid an allowance of not less than 76 cents per kilometre.

17.8 Transport of employees reimbursement

17.8.1 Where an employee commences and/or ceases work after 10.00 p.m. on any day or prior to 7.00 a.m. on any day and the employee's regular means of transport is not available and the employee is unable to arrange his/her own alternative transport, the employer must reimburse the employee for the cost of a taxi fare from the place of employment to the employee's usual place of residence. This shall not apply if the employer provides or arranges proper transportation to and or from the employee's usual place of residence, at no cost to the employee.

17.8.2 Provided always that an employee may elect to provide his or her own transport.

17.9 Cold work disability allowance

17.9.1 Employees principally employed on any day to enter cold chambers and/or to stock and refill refrigerated storages such as dairy cases or freezer cabinets shall be paid 22 cents per hour or part thereof, whilst so employed.

17.9.2 Provided that an employee required to work in a cold chamber where the temperature is below 0°C shall be paid in addition to the rate prescribed in 17.9.1 hereof 35 cents per hour. (An aggregate of twenty minutes in the hour shall be regarded as one hour’s work).
