16. ALLOWANCES AND/OR ADDITIONAL RATES

16.1 New South Wales

The rates set out in 16.5 shall be paid in addition to the appropriate weekly rates prescribed by the said 15.1, or the appropriate junior percentage rate:

16.2 An employee who attends an appropriate course of training at a technical college at the request of his/her employer shall be reimbursed at the completion of this course, if successful, the fees for such course.

16.3 An employee required to provide a bicycle or motorcycle shall be paid the amounts set out in Item 7 of 16.5 per week extra. An employee required to provide a motor car shall be paid the amount set out in Item 8 of 16.5 per week extra. Provided that where an employee occasionally uses his/her car by agreement with his/her employer, on the employer's business, he/she shall be paid an allowance for each kilometre so travelled as set out in Item 9 of 16.5. If the employer provides a vehicle, he/she shall pay the whole of the cost of the upkeep, registration, insurance and running expenses.

16.4 Freezer and dairy allowance

16.4.1 Employees whose primary function is the handling or loading of goods into or out of freezer rooms or freezer cabinet (ie., a room or cabinet with an inside temperature falling below 0 degrees Celsius) must be paid a disability allowance of the amount set out in Item 10 of 16.5, in the case of full-time employees and a pro rata amount in the case of casual and part-time employees;

16.4.2 Employees whose primary function is working in a public dairy room or backfilling a dairy cabinet must be paid a disability allowance of the amount set out in Item 11 of 16.5 per week in the case of full-time employees and a pro rata amount in the case of casual and part-time employees;

16.4.3 Employees whose primary function is backfilling in a freezer room (ie., a room with an inside temperature falling below 0 degrees Celsius), must be paid a disability allowance of the amount set out in Item 12 of 16.5 per week in the case of full-time employees and a pro rata amount in the case of casual and part-time employees.

16.97 per week

16.6 Where any employee is required to wear any cap, coat, overall or other uniform dress, and it is not supplied and paid for, by the employer, then the employer shall pay to the employee an allowance equal to the cost of the cap, coat, overall or other uniform dress and the cost of replacement items, when replacement is due to normal wear and tear.

Provided that, where by mutual agreement the laundering is done by the employee or the employer having refused, neglected or failed to launder the articles and laundering is done by the employee, the employee shall be paid the allowances set out in Item 4, of 16.5.

16.7 Where suitable protective clothing is not provided, upon request, to employees who are required to load or unload trucks or customers' vehicles, the employer must reimburse the employee for the cost of purchasing such suitable protective clothing.

16.8 Employees whose primary function is the handling or loading of goods into or out of freezer rooms or freezer cabinet (ie a room or cabinet with an inside temperature falling below 0 degrees Celsius) and who, working in freezer rooms, have not been provided with the following protective clothing at the employers expense:

16.8.1 fully insulated parka with hood;

16.8.2 fully insulated protective gloves;

16.8.3 fully insulated protective trousers (upon request);

then the employer must reimburse the employee for the cost of purchasing the above protective clothing.

16.9 Employees whose primary function is working in a public dairy room or backfilling a dairy cabinet and who have not been provided with the following protective clothing at the employers expense:

16.9.1 fully insulated parka with hood;

16.9.2 fully insulated protective gloves;

16.9.3 fully insulated protective trousers;

16.9.4 waterproof boots;

must be reimbursed by the employer for the cost of purchasing the above protective clothing.

16.10 Employees whose primary function is backfilling in a freezer room (ie a room with an inside temperature falling below 0 degrees Celsius), and who have not been provided with the following protective clothing at the employers expense:

16.10.1 fully insulated protective boiler suit;

16.10.2 fully insulated protective head gear;

16.10.3 fully insulated protective gloves;

16.10.4 fully insulated protective boots;

must be reimbursed by the employer for the cost of purchasing the above protective clothing.

16.11 Employees whose primary function is the handling or loading of goods into or out of freezer cabinets and who have not been provided, at the employers expense with fully insulated protective gloves and, upon request, a fully insulated parka must be reimbursed by the employer for the cost of purchasing such gloves and parka.

16.12 Employees whose primary function is the handling or loading of goods into or out of dairy cabinets and who have not been provided, at the employers expense with fully insulated protective gloves must be reimbursed by the employer for the cost of purchasing such gloves.

16.13 Where items of protective clothing detailed in this clause are not laundered by the employer at the employer's expense then the employer must pay to the employee the laundry allowance specified in Item 4, of 16.5.

16.14 Meal allowance

An employee who works overtime after 6.30 p.m. shall be paid, on such day, the amount set out in Item 1, of 16.5, as a meal allowance or with the prior agreement of the union shall be provided with a suitable meal approved of by the union.
