23. HOURS OF WORK AND ROSTERS

23.1 Weekly hours

23.1.1 The ordinary hours of work for each full-time employee without the payment of overtime, must not exceed an average of 38 hours per week (Monday to Sunday inclusive) in any four week period, within the times set out in 23.2.

23.1.2 The maximum number of days required to be worked for each full-time and part-time employee, without the payment of overtime each week is five days.

23.1.3 The maximum number of hours required to be worked for each full-time employee on any day, without the payment of overtime is nine hours, except that an employee may be rostered to work a 10.5 hour day and by mutual agreement in writing a second 10.5 hour day in any week.

23.1.4 The method of implementation of the 38 hour week may be any one of the following:

23.1.4(a) a shorter day or days each working week;

23.1.4(b) a shorter fortnight (four hours off in addition to the rostered day off);

23.1.4(c) a fixed day off in a four week cycle;

23.1.4(d) a rotating day off in a four week cycle; and

23.1.4(e) an accumulating day off in a four week cycle, with a maximum of five days being accumulated in five cycles.

23.2 Times of beginning and ending work

23.2.1 The ordinary times of beginning and ending work for full-time employees is:

Monday to Friday

7.00 a.m. to 9.00 p.m.

Saturday

7.00 a.m. to 6.00 p.m.

Sunday*

10.00 a.m. to 5.00 p.m.

23.2.2 *Despite work between the hours of 10.00 a.m. and 5.00 p.m. on Sunday being ordinary time, a full-time or part-time employee must agree to work on a Sunday and if she or he so elects must be paid double time per hour of the ordinary hourly rate for all time worked.
