26.1 Full-time employees
All full-time employees must be granted two rest periods on each day (Monday to Sunday inclusive). The first ten minutes is to be granted between the time of starting work for the day and the usual meal interval; and a second period of ten minutes is to be granted between the usual meal break and the time of finishing work for the day.
26.2 Part-time and casual employees
26.2.1 All part-time employees who work any period of four hours or more but no more than seven hours on any day (Monday to Sunday inclusive) must receive one rest period of ten minutes during the period of work.
26.2.2 If the work period includes a meal break, the rest period is to be granted in that portion of the work period which is the greater or where the work periods are of equal duration, the rest period of ten minutes must be given at a time that is mutually agreed between the employer and the employee.
26.2.3 Where the work period is of seven or more hours duration on any day (Monday to Sunday inclusive), two rest periods each of ten minutes duration must be granted, one during the period of work before and one during the period of work after the meal break.
26.3 Payment
All rest periods count as time worked.
26.4 Breaks between shifts
All employees are entitled to at least a twelve hour rest break between finishing work on one day and starting work the next day.
Variation to rest periods by agreement
An employer and a majority of employees/and or an employer and an employee may agree to take rest periods in a different way to that provided by this clause at a convenient time without diminishing the entitlement.
