15. HIGHER DUTIES

15.1 Outside of South Australia and New South Wales

15.1.1 An employee who is required to perform the duties of another employee in a higher classification for five consecutive working days or more will be paid for the period for which duties are assumed at a rate not less than the minimum rate prescribed for the higher classification.

15.1.2 In cases where the minimum rate of the higher classification is the same as the relieving employee’s current salary, the relieving employee will be paid at the higher classification at the first salary level above his or her current salary.

15.2 South Australia

In the State of South Australia, an employee required to perform all or substantially all the duties of a higher position for three days or more will be paid at the higher rate of pay appropriate to the position. The payment for higher duties will be subject to having completed five days either consecutively or individually in the higher position.

15.3 New South Wales

15.3.1 In the State of New South Wales, an employee who is required to perform the duties of another employee in a higher classification for any five days or more in a fifteen day period will be paid for the days on which those duties are performed at a rate not less than the minimum rate prescribed for the higher classification.

15.3.2 Clause 15.3.1 will only apply where a claim is made by the employee within one month of the end of such duties.

15.3.3 An employee required to perform the work of another employee will not suffer any reduction in his or her wage.
