24. ALLOWANCES

24.1 Vehicle and travelling allowance

24.1.1 Employees authorised by management to use their personal motor vehicle in the performance of duties for the Council, shall be paid an allowance for such a use at the relevant rate prescribed from time to time for employees of the State Service

24.1.2 Employees required to work at the corporation's refuse disposal area shall be paid $8.75 per shift or day as travelling allowance. This payment to be in addition to the ordinary rates and in lieu of the travelling allowances elsewhere specified by this clause.

24.1.3 When an employee working overtime finishes work at a time when reasonable means of transport is not available, the employer shall provide a conveyance or pay reasonable costs incurred.

24.2 Uniform and protective clothing

24.2.1 Council shall supply and meet the cost of uniforms or protective clothing where it is a work requirement that it be worn. In the event of disagreement between the council and the employee concerning the work requirements for a uniform or protective clothing, the matter shall be referred to a Board of Reference.

24.2.2 Outdoor employees shall be issued with two pairs of new overalls (or two pairs of trousers or two sets of bib and brace), two shirts, one pair of safety boots or safety shoes (which shall be worn at all times) each year free of charge. A bluey coat will be provided if required. Such items will be replaced where, in the opinion of the supervisor, they cease to become protective or serviceable. Alternative protective footwear shall be supplied on the recommendation of the city's medical officer of health.

24.2.3 Weatherproof clothing and gumboots or leggings and appropriate hats and gloves shall be provided where they are necessary due to the nature of the work.

24.2.4 Parking officers who are required to wear regulation uniform as prescribed by council shall, in addition to their uniform, be supplied annually with two pairs of shoes.

24.2.5 Employees shall be responsible for the care and maintenance of articles of clothing issued to them.

24.2.6 Employees losing, damaging or destroying any article of protective clothing shall pay for it, unless the Board of Reference otherwise decides.

24.2.7 The employer shall provide, free of charge, at the place of employment, oil or other suitable solvents for the removal of tar, bitumen, emulsion or other similar preparations from the persons of the employees.

24.2.8 The employer shall supply a washing machine and dryer for the use of the employees at Ti-Tree Bend Sewage Treatment Plant and other mutually agreed stations.

24.2.9 Spray operators shall be supplied with suitable respirator and gloves.

24.3 Sewage work

An employee required to perform any work connected with sewerage blockage, septic tank blockage, sewage logged trenches or sewerage pits shall be paid at the rate of double time during week days and triple time for work on public holidays and weekends whilst handling or working in direct contact with sewage matter.

24.4 Street sweeper

In addition to other payments due to him/her under this award a street sweeper who is required to commence duty before 5.00 a.m. shall be paid as follows:

24.4.1 if required to commence work at 3.00 a.m. - $3.95 per day.

24.4.2 if required to commence work at 4.00 a.m. - $1.95 per day.

24.5 Reopening allowance

24.5.1 Should the reopening prove objectionable, the supervising officer shall recommenced that the allowance be increased to $9.85 per grave.

24.5.2 Where an employee is required to perform work in connection with exhumation, he/she shall be paid an additional $9.85 for each exhumation notwithstanding however that the corporation may award the employee an increased allowance up to $49.80 inclusive of the base allowance providing that the medical officer of health in attendance certifies that the conditions encountered were objectionable or hazardous.

24.6 Depth allowance

24.7 Transport employees

24.7.1 Employee driving truck carrying bitumen-sprayer unit shall receive an extra $12.80 per week.

24.7.2 Employee operating truck with a crane mounted on chassis shall be paid an additional allowance of $2.60 per day or part thereof.

24.7.3 Motor (not being tractor) drawing trailer or other (drawn) item of mechanical equipment:

24.7.3(a) $2.30 extra per day for each loaded single-axled trailer or single axled (drawn) item of mechanical equipment, or $1.35 extra per day for each empty single-axled trailer;

24.7.3(b) $2.80 extra per day for each loaded double-axled trailer or double-axled (drawn) item of mechanical equipment, or $1.65 extra per day for each empty double-axled trailer;

24.7.3(c) Provided that not more than one trailer or drawn item of mechanical equipment shall be drawn at any one time;

24.7.3(d) This claim does not apply to supervisors and employees receiving in-charge rates.

24.7.4 Further additional amounts for employee driving vehicle collecting garbage $12.80 per week.

24.8 Height allowance/scaffolding allowance

24.8.1 In addition to other payments due to them under this award, employees shall receive the following payments if required to work at a height of:

24.8.2 Where an employee who is a licensed scaffolder is engaged to erect scaffolding subject to the Department of Labour and Industry inspection, an allowance of 1.3088 cents per hour shall be paid in addition to any other allowance prescribed in this award. (This allowance is in recognition of the additional skill and responsibility associated with such work and is additional to the rates associated with height as set out in 24.8.1.

24.9 Application of weedicides, etc.

24.9.1 Employees required to use toxic substances or materials of a like nature shall be informed by the employer of the health hazards involved and instructed in the correct and necessary safeguards which must be observed for the use of such materials.

24.9.2 Employees using toxic substances or materials of a like nature shall be paid 61cents per hour extra.

24.10 In charge allowance

24.10.1 Foremen and leading hands and/or employees in charge allowances (does not apply to employees classified above grade 3 level 12):

24.10.2 Provided always than an employee classified at level 12 and who is in receipt of an in charge allowance shall, when eligible for progression, progress to level 14.

24.11 Meal breaks and allowances

24.11.1 An employee shall not be compelled to work more than five hours without a meal break, except for emergency situations.

24.11.2 An employee working overtime shall be allowed a meal break of twenty minutes without deduction of pay after each four hours of work, if the employee continues to work after such meal breaks.

24.11.3 Employees required to commence duty not less than two hours before normal starting time, or remain on duty not less than two hours after normal finishing time, and who must in consequence obtain a meal away from home, shall be paid a meal allowance in accordance with State service rate.

24.11.3(a) This subclause shall not apply to museum employees on field work.

24.11.4 Rest periods - outdoor employees shall be allowed a period of ten minutes during the first part of the day or shift for a rest period without deduction of pay.

24.12 Working tools and tool allowance

24.12.1 All tools required by an employee, other than those usually provided by a tradesman and apprentices who receive tool allowances as prescribed in this award, shall be provided by the employer.

24.12.2 The employer shall provide for the use of the tradesmen all necessary power tools, special purpose tools, precision measuring instruments, and for sheet-metal workers snips used in cutting of stainless steel, monel metal and similar hard metals.

24.12.3 Compensation to the extent of the damage sustained shall be made where, in the course of the work, an employee's tools or clothing are damaged or destroyed through the use of corrosive substances; provided that the employer's liability in respect of tools shall be limited to such tools of trade as are ordinarily required for the performance of the employee's duties.

24.12.4 An employee shall be reimbursed by his employer to a maximum of $917.00 for the loss of tools by fire or breaking and entering, whilst securely stored at the employer's direction in a room or building on the employer's premises, job or workshop or in a lock-up as provided for in this award. Employee's tools are to be kept in a locked box and:

24.12.4(a) only tools provided and used by the employee in the course of his/her employment in accordance with 24.12.1 shall be subject to the provisions of this clause; and

24.12.4(b) the employee shall, if requested, furnish the employer with a list of tools so used.

24.13 Reimbursement of study fees

Where employees are required by the council to undertake a course of study, the council shall, subject to reports of satisfactory progress being received, reimburse all fees paid in respect of such course.
