PART 2 - DISPUTE RESOLUTION
7. PROCEDURE TO AVOID INDUSTRIAL DISPUTATION
The employer will ensure the employee has access to this award.
7.1 General grievances
Grievances or disputes will be dealt with in the following manner:
7.1.1 In the event of a grievance or dispute arising at work an employee shall raise it with the immediate supervisor;
7.1.2 In the event the matter is still unresolved the matter shall be referred to the Chief Executive Officer/Administrator;
7.1.3 If the matter has not been resolved the employee is entitled to involve an advocate, union or other representative to further discuss the issue with the Chief Executive Officer/Administrator;
7.1.4 If the matter remains unresolved either of the parties may refer the matter to the Australian Industrial Relations Commission for resolution. Paid leave of absence will be available to an employee who is required to attend any relevant proceedings pursuant to the provisions of the Workplace Relations Act 1996;
7.1.5 While the above procedure is being followed work shall continue as normal without interruption and all the parties will use their best endeavours to ensure that continuation. Nothing in this clause shall oblige an employee to perform work which is the subject of a genuine health or safety issue.
7.1.6 No party shall be prejudiced as to final settlement by a continuance of work in accordance with 7.1.5 hereof.
