9. COMMENCEMENT AND TERMINATION OF EMPLOYMENT

9.1 The contract of service shall be between the employee and the employer and may be terminated by not less than four weeks’ notice on either side given in writing on any day or by the payment or forfeiture as the case may be of four weeks’ salary. Provided that a lesser period of notice may be given subject to agreement between the employee and the employer.

9.1.1 In addition to this notice, employees over 45 years of age at the time of the giving of the notice, with not less than two years continuous service, are entitled to an additional week's notice.

9.2 Notwithstanding the provisions of subclause (1) of this clause, the employer may at any time, without prior notice, dismiss the medical practitioner for serious misconduct warranting such action.
