An employee who is directed by the employer to act in a position which is classified higher than the employee’s position and who performs the full duties for more than five consecutive days and accepts the full responsibility of the higher position shall, subject to the provisions of this award, be paid an allowance for the period so directed equal to the difference between the employee’s own salary and the salary the employee would receive if permanently appointed to the position in which the employee is so directed to act.
Where an employee is required by the employer to use their own vehicle for work related travel at the request of the employer, the employer shall pay the employee vehicle allowance in accordance with the vehicle allowance recognised by the Australian Taxation Office as adjusted from time to time.
14.3 On-call and recall allowances
14.3.1 For the purposes of this award an employee is on call when the employer requires the employee to remain readily contactable and available to return to work outside of the employee’s normal hours of duty. Recall is when an employee is required to return to duty outside of normal working hours. Such duty may not necessarily be performed at the employee’s normal place of work.
14.3.2 On-call allowance
Where an employee is required by the employer to be on call the employee shall be paid an allowance equal to 10% of the employee’s hourly rate of pay for each hour on call Monday to Friday and 15% of the employee’s hourly rate of pay for each hour on call on Saturday, Sunday and on public holidays, with a minimum payment of one hour.
14.3.3 Recall allowance
Where an employee is recalled to duty outside of normal working hours at the request of the employer, the employee shall be paid:
14.3.3(a) Actual travel time calculated to nearest fifteen minutes at the rate of the employee’s normal hourly rate of pay.
14.3.3(b) For the period on duty, at the rate of time and one half on week days and double time during the period midnight Friday to midnight Sunday, with a minimum payment of three hours, unless the employee is at the time receiving an on call allowance, pursuant to Clause 12(a), in which case it will be a minimum payment of one hour.
14.3.3(c) Where an employee is required to use his/her own vehicle, the employee shall be paid an allowance in accordance with subclause 17.2 of this award for the distance travelled for a return journey.
14.3.3(d) Where an employee is required by the employer to be on call, the employer will supply the employee with a telephone or other suitable form of communication and meet all costs associated with the installation, maintenance and use of the telephone. Provided that the employee will be responsible for all non-work related calls.
14.4 Conversion of on-call and recall allowances
By agreement between the parties the On-Call and Recall allowances contained in this award, where not taken as time off in lieu, may be applied as an annualised amount expressed as a dollar figure or as a percentage of the employee’s annual salary in addition to that salary. In this case, the dollar figure or the percentage is to be reviewed annually in the context of the actual incidence of on-call, recall and overtime.
