4. DEFINITIONS

4.1 Permanent employee

Shall mean either a full-time or part-time employee.

4.2 Casual employee

Shall mean a person engaged on an hourly basis to work when available and as required by Kmart.

4.3 Existing employee

Shall mean and include any full-time, part-time or regular casual employee (as defined) who was employed with the company as at 1 November 1994 and 9 January 1995 in the case of clerical employees.

4.4 Ordinary hours of work

Shall mean and include those hours of work which are within the span of ordinary hours contained in clause 16 - Hours of work and are days on which Kmart may lawfully trade.

4.5 Ordinary hourly rate

The ordinary hourly rate of pay for full-time and part-time employees shall be 1/38th of the appropriate weekly rate contained in clause 12 - Wages. The ordinary hourly rate of pay for casual employees shall be 1/38th of the appropriate weekly rate contained in clause 12 - Wages plus 20%.

4.6 Continuous service

Continuous service shall, for the purpose of leave accruals, include all service with the employer from the date of engagement, but shall not include in any anniversary year of accrual:

4.6.1 Unauthorised absences of more than one week,

4.6.2 Authorised unpaid absences of more than one week (including unpaid absences due to sickness).

4.7 Union

4.8 Clerks

4.8.1 Classification and rates of pay

All clerical and administrative employees covered by this award shall be graded according to the grading structure set out in this clause. Clerical and administrative employees shall be notified in writing by Kmart of their level and any change to their level.

4.8.2 Level 1

4.8.2(a) Employees in this level are responsible and accountable for their own work which is performed within established routine, methods and procedures.

4.8.2(a)(i) Employees shall be graded at this level where the principal functions of their employment, as determined by Kmart, require the exercise of any one form of the skill levels set out below:

4.8.2(a)(ii) Employees may be required to train other employees in the skills of their own grade by means of personal instruction and demonstration.

4.8.2(b) Typical duties/skill levels

4.8.3 Level 2

4.8.3(a) Employees in this level are responsible and accountable for their own work which is performed within established guidelines and exercise limited discretion within the range of their skill and knowledge. Routine and non-routine tasks are completed at this level.

4.8.3(a)(i) Employees shall be graded at this level where the principal functions of their employment as determined by Kmart, require the exercise of any one or more of the skills set out below:

4.8.3(a)(ii) Employees may be required to train other employees in the skills of their own grade and below by means of personal instruction and demonstration.

4.8.3(a)(iii) Employees may be required to give assistance and/or guidance (including guidance in relation to the quality of work) to employees in Level 1. Supervision in this role is general.
