5. INCIDENCE AND PARTIES BOUND
5.1 This award shall be binding upon Kmart Australia Limited and the Shop, Distributive and Allied Employees Association in respect of employees employed within retail shops (including restaurants) throughout Australia but excluding K Auto Service Centres in the classifications contained in this award whether members of the Shop, Distributive and Allied Employees Association or not.
5.2 It is agreed that this award will regulate the conditions of employment of all the above mentioned employees of Kmart to the exclusion of all other awards or Industrial Agreements with the exception of the Coles Myer Occupational Superannuation Award (refer clause 15.7).
5.3 It is agreed that employees employed within retail stores in a job graded position at or above the current Job Grade 4 level on appointment, or promotion to such a position, are not covered by the terms and conditions of this award.
5.4 This award shall not apply to shop assistants and employees in related classifications who are members of the Australian Workers Union and who are employed under the following Queensland State Award:
5.5 This award shall supersede the Kmart Australia Ltd Award 1994 [Print L6395].
