28.1 Meal break - day workers
28.1.1 On each of days Monday to Friday inclusive, employees on day work will be granted a meal break of not less than 30 minutes and not more than one hour between 11.00 a.m. and 2.00 p.m., unless other arrangements are made. No employee on day work will be required to work for a longer period than four and a half hours without a meal break unless by mutual arrangement between the parties.
28.1.2 Where such employee is required to work beyond 2.00 p.m. without having a meal break, double time rates will be paid from 2.00 p.m until the meal break is allowed.
28.2 Meal break - shift workers - other than seven-day shift workers
A shift worker, other than a seven-day shift worker, will not be required to work for more than five hours without a break for a meal.
28.3 Crib break - day workers
28.3.1 Monday to Friday
28.3.1(a) An employee working will be allowed a crib break of twenty minutes without deduction of pay after each four hours of overtime worked if the employee continues to work after the crib break.
28.3.1(b) Unless the period of overtime is less than one and a half hours, an employee, before starting overtime after working ordinary hours, will be allowed a crib break of twenty minutes which will be paid for at his/her ordinary-time rate.
28.3.1(c) An employer and employee may agree to any variation of this provision to meet the circumstances of the work in hand and agreement will not be unreasonably withheld by either party. The employer will not be required to make any payment in respect of any time allowed in excess of twenty minutes.
28.3.2 Saturday, Sunday and holiday
An employee required to work on a Saturday, Sunday or a holiday will be allowed a crib break of twenty minutes without deduction of pay after each four hours worked, provided he/she continues working beyond the crib break. The first prescribed crib break will, if occurring between 10.00 a.m. and 1.00 p.m., be paid at his/her ordinary-time rate. An employer and an employee may agree to any variation of this provision to meet the circumstances of the work in hand. The employer will not be required to make any payment in respect of any time allowed in excess of twenty minutes.
28.4 Crib break - seven-day shift workers
Twenty minutes will be allowed to a seven-day shift worker each shift for a crib break. This break will be counted as time worked.
