22.1 Subject to this clause, the ordinary hours of work shall be 38 per week, worked between 6.00 a.m. and 6.00 p.m., Monday to Friday.
22.2 Subject to the employer’s right to fix the daily hours of work for day workers from time to time within the spread of hours referred to in 22.1 and the employers right to fix the commencing and finishing time of shifts from time to time, the arrangement of ordinary working hours is to be by agreement between the employer and the majority of employees in the enterprise or part of the enterprise concerned. This does not preclude the employer reaching agreement with individual employees about how their working hours are to be arranged.
22.2.1 Matters upon which agreement may be reached include:
22.2.1(a) how the hours are to be averaged within a work cycle of 28 days or such longer period as may be agreed;
22.2.1(b) the duration of the work cycle for day workers provided that such duration shall not exceed three months;
22.2.1(c) rosters which specify the starting and finishing times of working hours;
22.2.1(d) a period of notice of a rostered day off which is less than four weeks;
22.2.1(e) substitution of rostered days off;
22.2.1(f) accumulation of rostered days off;
22.2.1(g) arrangements which allow for flexibility in the taking of rostered days off;
22.2.1(h) any arrangements of ordinary hours which exceed eight hours in any day.
22.2.2 By agreement between an employer and the majority of employees in the enterprise or part of the enterprise concerned, twelve hour days or shifts may be introduced subject to:
22.2.2(a) proper health monitoring procedures being introduced;
22.2.2(b) suitable roster arrangements being made;
22.2.2(c) proper supervision being provided;
22.2.2(d) adequate breaks being provided;
22.2.2(e) an adequate trial or review process being implemented through the consultative process at the workplace.
22.2.3 The ordinary daily hours of Milk carter’s assistants and Juniors on carts engaged in retail milk distribution shall be worked between the hours of 8.00 p.m. and 7.30 a.m.
22.2.4 An employee, other than those engaged under 22.2.3, engaged on day work who commences work prior to 6.00 a.m. shall be paid half time extra for all ordinary hours worked prior to 6.00 a.m., which shall be deemed to be part of the ordinary hours for the day.
22.2.5 Where practicable a meal break of up to one hour shall be given on each day.
22.2.6 The employer shall fix a regular starting time or times for all employees. Such starting times and meal and other breaks may be staggered for different employees to facilitate the continuous running of the plant and equipment.
