12. SALARY RATES AND PAYMENT OF SALARIES

12.1 Classifications and Rates of Pay

Employees performing work within the classifications listed in the Tables in this clause will be paid annual salary at no less than the minimum rate adjacent to the relevant classification as set out in the Tables in this clause.

12.1.1 The rates of pay in this award include the arbitrated safety net adjustment payable under the Safety Net Review – Wages May 2002 decision [PR002002]. This arbitrated safety net adjustment may be offset against any equivalent amount in rates of pay received by employees whose wages and conditions of employment are regulated by this award which are above the wage rates prescribed in the Award. Such above-award payments include wages payable pursuant to certified agreements, currently operating enterprise flexibility agreements, Australian workplace agreements, award variations to give effect to enterprise agreements and overaward arrangements. Absorption which is contrary to the terms of an agreement is not required.

12.1.2 Increases made under previous National Wage Case principles or under the current Statement of Principles, excepting those resulting from enterprise agreements, are not to be used to offset arbitrated safety net adjustments.

12.1.3 Where an employee whose wages and conditions were regulated by this award immediately prior to 22 August 2002 that employee may be eligible for a higher rate in accordance with Schedule A.

12.2 Juniors

12.2.1 Employees who are younger than 21 years of age and who are employed in the classifications of:

Cadet – practical training
Administrative Service Officer Class 1

Will be paid no less than an annual salary calculated (to the nearest dollar) by applying the percentages specified below, to the minimum salary rate for the relevant classification.

Under 18 years 60%
At 18 years 70%
At 19 years 81%
At 20 years 91%

12.3 National Training Wage and Trainees

12.3.1 Cadets – Full time study rates

A cadet, during periods of full-time study, will be paid no less than 57% of the minimum salary (including junior rates where applicable) that would be payable to the Cadet if he/she was performing practical training.

12.3.2 Cadet various – salary rates

Table 12.3.2A sets out the salary rates applicable to the following classifications.

12.3.3 National Training Wage: The terms of the National Training Wage Award 1994, as varied from time to time, will apply to the following classifications as though the provisions are included in this award.

12.22 Payment of salaries

12.22.1 Subclause 12.22 applies to the classifications contained in clause 12, which do not have an asterix shown against them, only.

12.22.2 Fortnightly pay: Unless otherwise agreed between the Chief Executive and the majority of employees, employees will be paid fortnightly.

12.22.3 Formula: The fortnightly rate of pay will be ascertained by applying the following:
