20.1 Definition
For the purposes of this award an adult apprentice means a person of 21 years of age or over at the time of entering into an indenture to one of the trades specified in clause 18 - Apprenticeship of this award.
20.2 Application of general conditions of apprenticeship
The provisions of clause 18 - Apprenticeship herein shall apply to adult apprentices unless specifically provided otherwise by this clause.
20.3 Contract of indenture
20.3.1 A suitable contract of indenture shall be drawn up between the adult apprentice and the employer stipulating:
20.3.1(a) the names of the parties;
20.3.1(b) a statement of the trade or trades to which the adult apprentice is to be bound and which he or she is to be taught during the course and for the purpose of the apprenticeship;
20.3.1(c) the duration of the contract;
20.3.1(d) the credits to be granted in accordance with 20.3.2 below;
20.3.1(e) the details of the training to be successfully completed in order to gain recognition as a tradesperson;
20.3.1(f) a covenant by the employer to teach and instruct or cause the adult apprentice to be taught or instructed in the trade to which the adult apprentice is bound;
20.3.1(g) a covenant that for the duration of the contract of indenture the adult apprentice shall be of good conduct and shall diligently pursue his/her course of instruction;
20.3.1(h) the date of which the apprenticeship is to commence or from which it is to be calculated;
20.3.1(i) all other conditions of apprenticeship.
20.3.2 The training to be completed by an adult apprentice under a contract of indenture will be determined by the relevant State Training Authority through its approved agencies based upon training credits being granted for the relevant working experience and educational standard obtained by the apprentice.
20.4 Wage rate
20.4.1 Where a person was employed by an employer in the metal and engineering industry immediately prior to becoming an adult apprentice with that employer, such person shall not suffer a reduction in the rate of pay by virtue of becoming indentured.
20.4.2 For the purpose only of fixing a rate of pay the adult apprentice shall continue to receive the rate of pay that is from time to time applicable to the classification or class of work specified in clause 13 - Classifications and wage rates of this award and in which the adult apprentice was engaged immediately prior to entering into the contract of indenture.
20.4.3 Subject to 20.4.1 hereof the rate of pay of an adult apprentice shall be the minimum wage prescribed by clause 13 - Classifications and wage rates hereof or the rate prescribed by 18.7 hereof for the relevant year of apprenticeship whichever is the greater.
