21.1 The ordinary hours of duty shall be 38 hours per week to be worked between 6.00 a.m. and 6.00 p.m. Monday to Friday inclusive.
21.2 Where an agency operates according to a nineteen day - four week cycle, the Metropolitan Transit Authority (Hours of Work) Award 1982 (Print M0238) or an agency specific hours of work agreement shall apply.
21.3 The spread of hours, hours per week or days upon which ordinary hours may be worked may be altered as to all or a section of the employer’s staff, by agreement between the employer and employees, the union or other employee representative, and provided that the ordinary hours shall not average more than 38 hours per week.
21.4 Where there is agreement in accordance with this clause, ordinary hours not exceeding twelve on any day may be worked subject to:
21.4.1 proper health and monitoring procedures being introduced;
21.4.2 suitable roster arrangements being made;
21.4.3 proper supervision being provided;
21.4.4 adequate breaks being provided; and
21.4.5 an adequate review process being implemented through the consultation process in clause 8.
21.5 Two tea breaks of seven and a half minutes duration on each day to be counted as time worked shall be allowed to employees other than shift workers without deduction of pay. The employer shall fix the time for the commencement of the tea break and that by agreement the two tea breaks may be combined and taken as a fifteen minute tea break in the morning.
