25.1 All work done at times other than those which the employee is rostered to work, or outside the daily spread of eleven hours, or beyond ten hours in any one day or beyond five days in any one week or beyond 38 hours in any one week - except in the case of an employee rostered over a nineteen day, four week cycle as provided by 23.2 in which case the limit to weekly ordinary hours shall be 40 - shall be overtime.
25.2 Subject to the provisions of 25.3 hereof, all overtime worked between Monday to Friday, both inclusive, and prior to twelve noon on Saturday shall be paid for at the rate of time and a half for the first two hours and double time thereafter. All overtime worked after twelve noon on a Saturday and all day on a Sunday, shall be paid for at the rate of double time. When double time becomes payable it shall continue until the conclusion of the overtime.
25.3 All work done on an employee’s rostered day off shall be paid for at the rate of double time with a minimum payment as for three hours work.
25.4 Notwithstanding anything contained in this paragraph an employer and an employee may agree that time off with pay may be allowed in lieu of payment for overtime. Such time off in lieu shall be allowed subject to:
25.4.1 Time off for each hour or part thereof shall be equivalent to the overtime rate that otherwise would have been paid.
25.4.2 The time of taking time off being agreed at the time of arranging the overtime and shall be no later than four weeks after the overtime is worked.
25.4.3 An employee is entitled to choose payment or time off in lieu of payment on each occasion overtime is worked.
25.4.4 The employer shall maintain a record of each occasion the employee elects and takes time off in accordance with the provisions of this clause.
25.4.5 Where an employer and an employee agree to the taking of time off in lieu of overtime in accordance with the provisions of this clause, such an agreement shall be recorded in writing.
