31. HOLIDAYS

31.1 The following days shall be allowed as holidays without deduction of pay for full-time and part-time employees: New Year’s Day, Australia Day, Labour Day or Eight Hour Day, Good Friday, Easter Monday, Easter Saturday, Anzac Day, Sovereign’s Birthday, Christmas Day and Boxing Day (except in South Australia where Proclamation Day shall be observed as a holiday) or such other day as is generally observed in a locality as a substitute for any of the said days respectively.

31.2 In addition to the holidays prescribed in 31.1 one (two in the ACT) additional public holiday shall apply to an employee in each state or territory where the award operates in the manner set out below:

In Victoria:

Melbourne Cup Day

In South Australia:

Adelaide Cup Day

In New South Wales:

Picnic Day (first Tuesday in November)

In Northern Territory:

Show Day

In ACT:

Picnic Day (first Monday in March)

 

Canberra Day

31.3 All work done on any of the holidays prescribed in this clause by any employee shall be paid at the rate of double time and a half of the full-time rate with a minimum payment of three hours.

31.4 Where a full-time employee’s rostered day off coincides with any of the holidays prescribed in this clause, such employee shall receive one day’s additional pay at ordinary rates from the employer on the next succeeding pay day.

31.5 Where a part-time employee is rostered such that the day of the week on which a holiday as prescribed by this clause falls forms part of the roster but the employee is not rostered to work on the holiday then such employee shall receive additional payment for the number of hours regularly worked on that day of the week from the employer on the next succeeding pay day.
