PART 8 - AWARD COMPLIANCE/UNION AND EMPLOYER MATTERS 

40. PAYMENT OF WAGES

40.1 The employer may elect to pay employees in cash, by cheque or by means of credit transfer to a bank, building society or credit union account in the name of the employee. The day that the credit transfer is credited to the employee’s account shall be deemed to be the date of payment.

40.2 Payment shall be made within three days of the last day of the pay period. Payment by cash or cheque shall be made during the employee’s ordinary working hours. However, unless otherwise agreed between the employer and employee the actual day on which employees are paid i.e. payday, shall be regular and shall not change from week to week, or fortnight to fortnight.

40.3 No employer shall change its method of payment including the payday as described in 40.2 to employees without first giving them at least four weeks notice of such change.

40.4 Employees whose day off falls on pay day and who are paid by cash or cheque shall be paid their wages upon request from the employee to the employer, prior to the employee taking the day off.

40.5 An employee who lawfully terminates employment or is dismissed for reasons other than misconduct, shall be paid all wages due to the employee by the employer on the day of termination of employment, or within 24 hours following such termination.

40.6 At the time of being paid each employee shall be issued with a statement by the employer showing the gross wages and allowances and all deductions made there from.
40.7 The employer may elect to pay employees weekly or fortnightly in accordance with 40.1 to 40.6 inclusive.

40.7.1 The employer shall not change the frequency of payment to employees without first giving them and the union at least four weeks notice of such change.

40.7.2 The method of introducing a fortnightly pay system shall be by the payment of an additional weeks wages in the last weekly pay before the change to fortnightly pays to be repaid by equal fortnightly deductions made from the next and subsequent pays, provided that the period of repayment shall not be less than ten weeks or by some other method agreed upon by the union and the employer.
