17. ALLOWANCES

PART A - NON-SALARIED ALLOWANCES

17.1 Meal allowance

17.1.1 Where an employee is required either before or after ordinary hours of duty to work additional hours (and after a meal break would ordinarily occur) they are entitled to the payment of a meal allowance of $19.15 if it is not practical to return home for the meal.

17.1.2 The applicable circumstances and adjustment of rates from time to time will be in accordance with AIRC wage fixing principles.

17.2 Travelling allowance

17.2.1 An allowance in respect of accommodation, meal(s) and incidental expenses will be payable to an employee who undertakes travel on official business and is required to be absent overnight.

17.2.1(a) Travelling allowances are in addition to the cost of conveyance.

17.2.1(b) An employee who is travelling to a place of work in anticipation of permanent relocation to that place of work, and who has been advised in writing that the relocation is to be made permanent, will not be eligible to receive travelling allowance during employment at that place of work.

17.2.2 Rates of travelling allowance

An employee who is required to be absent overnight from the employee’s usual place of work on official business, will be paid:

17.2.2(a) the appropriate rate of allowance under 17.2.1, as specified in Table 17A, or

17.2.2(b) where MPL is satisfied that the allowance is insufficient for or in excess of expenses, an amount equal to reasonable expenses incurred.

17.2.3 Rates of travelling allowance - more than 21 days: After an employee has resided in the one locality for a continuous period of 21 days, the employee will be paid an allowance equal to the amount expended on accommodation, meals and incidentals, or an amount considered to be reasonable in the circumstances.

17.2.4 Part day travelling allowance: An employee who is required to be absent from the employee’s usual place of work on official business for a period of not less than 10 hours but is not absent overnight, may be paid the appropriate rate of allowance as specified in Table 17A.

17.3 Excess travelling time

17.3.1 Excess travel

An employee who is travelling or on duty away from the employee’s usual place of work will be paid for time necessarily spent in travel or on duty (exclusive of overtime duty) in excess of:

17.3.1(a) the employee’s usual hours of duty for the day; and

17.3.1(b) the time necessarily spent travelling to and from home and the usual place of work.

17.3.1(c) the payment of excess travelling time to an employee based at home under home-based employment, will be calculated from the employee’s office based site.

17.3.2 Minimum time

Payment will not be made unless the excess time exceeds:

17.3.2(a) one half hour in any one day; or

17.3.2(b) two and one half hours in any fortnight,

payment will not be made for more than five hours in any one day.

17.3.3 Rate

The rate of payment will be:

17.3.3(a) single time on Mondays to Saturdays; and

17.3.3(b) time and a half on Sundays and Public Holidays.

17.3.4 Allowance for salary purposes

An allowance paid under clause 16 - Higher duties allowance, will be regarded as salary for the purposes of calculating excess travelling time.

17.3.5 Barrier

Employees in receipt of a salary exceeding $34,720 will not be entitled to payment for excess travelling time.

17.3.6 Usual place of work

Notwithstanding the provisions of this clause, where an employee’s usual place of work is variable within a specified district, the Agency Head will determine the usual place of work. In this case a minimum of 20 minutes travelling time each way will apply.

17.3.7 Excess fares

An employee will be entitled to the reimbursement of excess fares incurred by the employee performing duty temporarily at a place other than the employee’s usual place of work, when the cost of travelling to and from the temporary place of work is greater than the cost of travelling to and from the employee’s usual place of work.

17.3.7(a) An employee in receipt of travelling allowance will not be paid an allowance under this clause.

17.3.7(b) An employee who has been notified in writing to proceed to a place of work in anticipation of a permanent relocation to that place of work will not be paid an allowance under this clause.

17.37(c) The payment of excess fares to an employee based at home under home based employment, will be calculated from the employee’s office based site.

17.3.8 Time off in lieu

Time off in lieu may be granted, in accordance with 20.6 in substitution for/in lieu of payment of excess travelling time.

17.4 Motor vehicle allowance

17.4.1 Where an employee is authorised to use a private motor vehicle owned or hired by that employee for official purposes, or permission is granted for an employee to use the private motor vehicle for:

17.4.1(a) a specific journey or purpose; or

17.4.1(b) to return to the employee’s permanent station to take recreation leave where the employee has been temporarily relocated from one place to another,

and use of the private motor vehicle will incur less expense for the Company or provide greater efficiency, the employee will be paid the appropriate rate of allowance per kilometre as specified in Part A of Table 17B.

17.4.2 The payment of motor vehicle allowance to an employee based at home will be calculated from the employee’s office based site.

17.4.3 Where an employee is authorised to use a private motor vehicle for the transport or haulage of goods or materials weighing 100 kilograms or more and/or the conveyance of passengers, the costs of which would otherwise be met by the Commonwealth, the employee will be paid an additional allowance under Part B of Table 17B.

17.4.4 Variations to allowance

The rate(s) of motor vehicle allowance as specified in Table 17B may be varied where an employee can demonstrate that the allowance payable under 17.4 is insufficient to meet reasonably incurred expenses, due to official use of the employee’s private motor vehicle, in which case reimbursement of the actual expense incurred may be approved by MPL.

17.5 District allowance

17.5.1 Eligibility for district allowance

An employee residing in a locality listed in Table 17C is entitled to be paid district allowance.

17.5.1(a) An employee may, where the employee is in receipt of travelling allowance under 17.2, be paid district allowance in addition to travelling allowance while temporarily stationed in a locality that would normally attract the payment of district allowance where MPL considers this appropriate.

17.5.1(b) MPL may increase the travelling allowance payable in such a locality should higher costs in the locality justify such and increase.

17.5.2 Rates of district allowance

The annual rate at which district allowance is payable to an employee is specified at Table 17D.

17.5.3 Eligible dependant/eligible partner

17.5.3(a) Is a dependant or partner who resides with the employee, and whose income, if any, is less than $14,363 per annum.

17.5.3(b) An employee with a spouse or partner who is also entitled to the payment of district allowance under 19.5.1 will be regarded as an employee without dependants for the calculation of district allowance.

17.5.4 District allowance during recreation leave

Where an employee is entitled to the payment of district allowance on the day immediately prior to the commencement of a period of recreation leave, the payment of district allowance will continue during the recreation leave, irrespective of where the employee resides during the leave.

17.5.5 Inclusion of other eligible localities

If MPL employs at a future date any employees at a location not covered by Table 17C but that would attract a payment of district allowance under the provisions of the Australian Public Service Award 1998, as varied from time to time, MPL agrees to reinstate the payment of district allowance for that locality at the rate payable under the Australian Public Service Award 1998 at that time.

17.6 Allowance for office disabilities

17.6.1 Payment of an allowance

MPL will seek to prevent employees from being subjected to any “disabilities”. In situations where “disabilities” exist at a particular office location due to unavoidable or other particular circumstances, MPL and union or other employee representatives will negotiate without delay on the payment of an appropriate disability allowance consistent with the provisions of the wage fixation principles. Where employees are temporarily relocated, the temporary location will not be the “usual place of work” for the purposes of 17.3. Where no agreement can be reached on the application of this clause, the matter may be referred to the AIRC.

17.6.2 For the purposes of this clause:

17.6.2(a) Disabilities means any detrimental effects on the working conditions of office based employees caused by a variety of factors associated with “building activities”, including one, or generally more, of the following: dust, noise, fumes, heat, vibrations, cold, wet, dirt, loss of amenities, general inconvenience.

17.6.2(b) Building activities means any construction, building, alterations or refurbishment activities which may cause disabilities at an office location.

PART B – SALARY RELATED ALLOWANCES

17.7 First aid certificate allowance

17.7.1 Where an employee possesses a current first aid certificate and continuing ability commensurate with that qualification, MPL may assign incidental first aid responsibilities to the employee. Such an employee will be paid an allowance in accordance with the relevant qualification as set out in Table 17E:
