21. OVERTIME - MINIMUM PAYMENT

21.1 Where an employee is required to perform overtime duty, and such duty is not continuous with ordinary duty (excluding meal breaks), the minimum overtime payment payable for each separate overtime attendance will be four hours at the prescribed overtime rate.

21.2 Where an overtime attendance not continuous with ordinary duty, involves duty both before and after midnight, the minimum payment provisions of this clause will be satisfied when the total payment for the whole of the attendance equals or exceeds the minimum payment applicable for one day. Where a higher overtime rate applies on one of the days, the minimum payment will be calculated at the higher rate.

21.3 Employees, other than part-time employees who perform overtime duty whilst in any restriction situation (as per clause 23 - Restricted duty,) are paid:

21.3.1 a minimum overtime payment for three hours (in lieu of the four hours prescribed in 21.1); and

21.3.2 on multiple attendances a minimum payment of three hours is payable for each attendance (subject to the total not exceeding what would have been payable if the attendance had been unbroken).

21.4 The provisions of this clause do not apply to clause 24 - Emergency duty.
