8.1 A part-time employee is an employee specifically hired as a weekly employee, but who does not work full-time hours.
8.2 Regular part-time employment
8.2.1 An employer may employ regular part-time employees under this award.
8.2.2 A regular part-time employee is an employee who:
8.2.2(a) works less than full-time hours of 36 per week; and
8.2.2(b) has reasonably predictable hours of work; and
8.2.2(c) receives, on a pro rata basis, equivalent pay and conditions to those of full-time employees unless the award specifically excludes such employees and/or provides some alternative provisions in relation to part-time employees.
8.2.3 At the time of first being employed, the employer and the regular part-time employee will agree, in writing, on a regular pattern of work, specifying at least:
8.2.4 Any agreed variation to the regular pattern of work will be recorded in writing and retained by the employer and a copy given by the employer to the employee.
8.2.5 An employer is required to roster a regular part-time employee for a minimum of four consecutive hours on any shift.
8.2.6 An employee who does not meet the definition of a regular part-time employee and who is not a full-time employee will be paid as a casual employee in accordance with 9.1.5.
8.3 The company may notify a part-time employee on the previous day whether the part-time employee will be required to work on any given day. A part-time employee required to work on any given day must be provided with at least four hours work. Subject to the four hour minimum, the actual finishing time of a part-time employee on any given day may be specified by the company during the course of each day to suit the actual needs of the business.
8.4 Part-time employees are paid the same hourly rate as full-time employees, i.e. the appropriate weekly rate divided by 36. Part-time employees are entitled to be paid the same ordinary time penalties as full-time employees.
8.5 Part-time employees who work overtime shall receive the same overtime penalties as full-time employees.
8.6 Where the part-time employee agrees to do so, a part-time employee may work temporarily as a full-time employee to replace a full-time employee who is on leave. A part-time employee who is temporarily transferred to full-time employment under this clause must be given at least one week’s notice of the transfer.
8.7 Existing casual employees as at 1 June 1990 shall not be required to become part-time employees without their agreement.
