9. RATES OF PAY

9.1 Weekly employees

9.1.1 Adult employees in the classifications set out in this clause must be paid a weekly rate not less than the rate set out below:

9.1.2 Safety net adjustment

The rates of pay in this award include the arbitrated safety net adjustment payable under the Safety Net Review – Wages May 2004 decision [PR002004]. This arbitrated safety net adjustment may be offset against any equivalent amount in rates of pay received by employees whose wages and conditions of employment are regulated by this award which are above the wage rates prescribed in the award. Such above-award payments include wages payable pursuant to certified agreements, currently operating enterprise flexibility agreements, Australian workplace agreements, award variations to give effect to enterprise agreements and overaward arrangements. Absorption which is contrary to the terms of an agreement is not required.

Increases made under previous National Wage Case principles or under the current Statement of Principles, excepting those resulting from enterprise agreements, are not to be used to offset arbitrated safety net adjustments.

9.1.3 Junior employees shall be paid the following percentages of the appropriate rate set out in 9.1.1:

9.1.3(a) Rate to be determined by applying percentage to appropriate age and classification.

9.1.3(b) Total wages to be calculated to the nearest 10 cents, any fraction not exceeding four cents to be disregarded.

9.1.4 If an employee is authorised by his employer to take charge of other employees and is required to:

9.1.4(a) set out work; or

9.1.4(b) see that work is carried out,

they shall be regarded as a leading hand and shall be paid an additional allowance as prescribed hereunder:

9.1.5 Casual employees shall be paid per hour 1/36th of the appropriate rate prescribed by this clause, plus 25%. Provided that for employees employed after the commencement of this award the rate shall be 20%.
